zDiskuss Terms of Service

BY ACCESSING AND USING zDiskuss, YOU AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, PLEASE DO NOT USE THE SERVICE.

1. Eligibility

You must be at least 16 years of age to use this Service. Users under 18 years of age are prohibited from accessing, posting, or engaging with sexually explicit content on the platform. By creating an account, you represent that you meet these age requirements.

2. Account Responsibilities

You are solely responsible for maintaining the confidentiality of your account and for all activities occurring under your account. You hereby agree to:

  • Create your account by providing valid and true information
  • Keep your password secure and your account information not shared with others
  • Not access other users' accounts without valid reasons (e.g. shared accounts)
  • Not to create multiple accounts for ban evasion, harassment, or manipulation of site features
  • Report security vulnerabilities to site administrators immediately upon discovery

3. Acceptable Use Policy

3.1 Forbidden Materials
You agree not to upload, post, or transmit any content that:

  • Is illegal under applicable law
  • Displays real life pornography, gore, extreme violence, or child exploitation material
  • Contains AI-created images, including but not limited to AI art, AI videos, or AI-generated pornographic material
  • Constitutes spam, unsolicited advertising, or commercial solicitation
  • Violates intellectual property rights of others (see Section 3.2)
  • Contains malware, viruses, or other harmful codes

3.2 Intellectual Property and Content Attribution
Users may only post original content created by themselves. It is not allowed to post artworks created by others except for in the following cases:

  • The artwork incidental in a photograph or screenshot, e.g. posters in background, desktop wallpaper
  • It is used in a transformative or creative way, constituting fair use
  • Material is a sticker, banner, or graphic and is clearly created for profile decoration and to be reused

3.3 Classification of Mature Content
Artistic content with mature themes is allowed provided proper content warnings are given:

  • NSFW: Posts should be tagged as NSFW if they depict nudity, feature sexual themes, or have explicit artistic depictions, including illustrated content such as hentai
  • NSFL: Extreme artistic content including graphic violence (including guro), extreme fetish material, or other disturbing imagery must be tagged as NSFL

Failure to appropriately label mature content risks the removal of content and/or suspension of your account.

3.4 Conduct Standards
You agree to behave in an appropriate manner. The following are not allowed:

  • Harassment, bullying or personal targeted attacks against other users
  • Hate speech, that is, racism, homophobia, transphobia, and anything discriminatory in nature
  • Current political discourse, content, or anything that can otherwise be considered as such. This is a no-tolerance policy, and you will be permanently banned without warning.
  • Impersonation of other persons or entities
  • Coordinated harassment campaigns or brigading
  • Doxxing or making private information about others public without consent

4. Ownership of Content and License

You retain ownership of all content you post to the Service. By posting content, you grant zDiskuss a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content as necessary to operate the Service. This license terminates when you delete your content, except where content has been shared or reposted by other users.

5. Disclaimer of Liability

The Service is provided "as is" without warranties of any kind. You acknowledge and agree that:

  • You are solely responsible for all content you post or transmit through the Service
  • zDiskuss does not bear any responsibility for user-generated content and users' actions
  • zDiskuss makes no guarantee of service uptime, data preservation, or uninterrupted access
  • You use the Service at your own risk

6. Enforcement and Moderation

zDiskuss administrators reserve the right to remove any content or terminate any user account at their sole discretion. Violations of these Terms may result in:

  • Content removal or editing
  • Temporary account suspension
  • Termination of account permanently
  • Reporting to appropriate authorities where legally required

We make moderation decisions on a case-by-case basis, and all decisions are final. We may take enforcement action without first providing notice.

7. Indemnification

You agree to indemnify and hold harmless zDiskuss, its operators, and administrators from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

8. Changes to Terms

We are entitled to change the Terms at our discretion. Continuing to use the Service after a change constitutes acceptance of the modified Terms. Material changes will be communicated via site announcements.

9. Termination

You can cancel your account any time by contacting site administrators. We may at any time, terminate or suspend your access to all or part of the Service with or without cause or notice.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or use of the Service shall be resolved in accordance with the dispute resolution procedures determined by site administrators.
